Weeding out weak patents: Patent invalidation by the Patent Trials and Appeals Board

Abstract:

One of the vexing problems the US patent system faces is that many patents issued by the US Patents and Trademarks Office (USPTO) may not stand the test of validity. These ‘invalid’ patents decrease the efficiency of innovative activities by burdening innovators with unnecessary costs of licensing or litigating patents. To address this situation, the American Invents Act (2011) introduced the Patent Trials and Appeals Board (PTAB), which allows third parties to contest the validity of a patent. The purpose of this study is to examine the effects of Inter Partes Review and Covered Business Method Review procedures of the PTAB using the population of hitech (semiconductors, telecommunications) patents contested at the PTAB between since the inception of PTAB.
