Maurits Barendrecht (1956) practiced law at a major Dutch law firm (1982-1997) and is professor of Private Law at Tilburg University since 1992. He studies dispute systems (legal procedures, negotiation processes, ADR, informal dispute mechanisms) from an interdisciplinary perspective. He systematically looks for knowledge from economics, psychology, organisation theory, negotiation theory, and conflict studies that may be integrated with best practices, in order to improve dispute systems so that they serve the interests of the people that rely on them in a better way.

His research takes places within †Tisco (Tilburg Institute for Interdisciplinary Studies of Civil Law and Conflict Resolution Systems). He is also†academic director of HiiL Innovating Justice, a leading innovation institute for the justice sector in which Tilburg University participates. Here, he assists courts and other justice sector organisations with developing innovative procedures and measuring access to justice. He also consults on strategies based on innovation.

Innovation projects

Barendrecht has lead several large scale innovation projects in the realm of justice and governance, which directly address urgent justice needs which are difficult to cope with through existing legal arrangements. These interactive research and development projects usually take place in cooperation with stakeholders such as client groups, ministries of justice, the judiciary, or those involved in the supply of legal services.

Examples of innovations that took place under his leadership are:

  • Common European Rules regulating service contracts (European Civil Code Project, now part of the draft Common Frame of Reference for European Contract Law)
  • A Code of Conduct for Settling Personal Injury claims (developed with and now accepted by a large majority of insurance companies and organizations representing victims)
  • A strategic agenda for improving access to justice, developed for the UN High Level Commission on Legal Empowerment of the Poor together with international experts (Making the Law Work for Everyone 2008, Report Working Group I on Access to Justice)
  • An approach for effective legal aid, improving access to justice with lower costs (developed with legal aid stakeholders in the Netherlands; accepted as a policy by Dutch Ministry of Justice and Parliament in 2008).
  • Internet applications for legal advice and online divorce (developed with stakeholders and client panels; now in operation as by the Dutch legal aid board)
  • A tool with handbook for measuring access to justice (now used in 20 countries and the handbook downloaded 6000 times).
  • The concept and methods of Microjustice, now being developed further in cooperation with NGO's and legal services providers.
