Impact of Decree 8058/2013 on antidumping activity in Brazil and research agenda

Brazil was one of the main users of anti-dumping measures in the last decade. Decree 8.058/2013 (the "2013 Decree") changed the procedures regarding anti-dumping investigations in Brazil. Its purposes, as set forth in the 2011 Government Industrial Policy document “Greater Brazil Plan”, were to intensify trade defense measures, reduce investigation processing time, and grant provisional duties during the investigation. We present the main trends of trade defense in Brazil and in the world and discuss the effects of the 2013 Decree on anti-dumping investigations. In particular, it is shown that (i) the number of investigations has increased since the release of the Brazilian Government Industrial Policy document, (ii) the success rate of investigations has not increased after the 2013 Decree, and (iii) investigation time declined after the 2013 Decree but is still statistically higher than other countries.
