TILT seminar by Dr. Nicolo Zingales

Topic: "The rise of infomediaries and the marketization of data protection enforcement"

Nicolo Zingales is a Lecturer at Sussex Law School, where he teaches antitrust, IP and data protection law. He is also affiliated researcher to TILT, TILEC and the Stanford Center for Internet and Society. His research spans across different areas of internet law and governance, particularly in shaping the roles and responsibilities of intermediaries in the online ecosystem.

Abstract

With the data economy, personal information has become a valuable asset not only for companies offering customized goods and services or whose business model depends on selling consumer data to third parties, but also and increasingly, for consumers themselves.

Consumer awareness about the value of the information they provide is on the rise, as various options to trade, compare and extract value from that information become available. The General Data Protection Regulation (GDPR) makes a substantial contribution to consumer empowerment by strengthening enforcement, and granting new substantive rights such as the right to data portability, the right to be forgotten and the so called right to "explanation" for automated decision-making.

While the breadth of scope of those rules still needs to be fleshed out through interpretation, the incentives are clearly lined up for the rise of intermediary entities specializing in the enforcement of data subject rights. ThisĀ  creates the conditions for a perfect storm in data protection law, pitting data-driven businesses against this new powerful force of "infomediaries", who are likely to alter the competitive dynamics in the online ecosystem by providing a centralized avenue for personal information management and collective empowerment.

This presentation aims to reflect on the opportunities and challenges associated with the reliance on third parties for the exercise of data protection rights, contextualizing it as part of the more general trend towards "marketization" of enforcement initiated by the GDPR.
