Incremental value interpretation of FRAND under complementary inputs

The incremental value interpretation of FRAND licensing suggests that royalties for standard-essential patents should not exceed the incremental value of the patented technology over the next best alternatives. However, the simple interpretation of incremental value rule does not accommodate well the case of multiple complementary inputs. When the incremental value notion is extended for complementary inputs, through the concept of ex ante competition, the incentives are not necessarily align with the social contribution, and social welfare could be improved if the incremental value restriction is relaxed.
